SMS Terms (Mobile Messaging Program)

These SMS Terms (these "SMS Terms") govern your participation in the mobile messaging program (the "Program") offered by Crane Health Holdings LLC d/b/a Mainstay Naturals, 1500 N Grant St #7971, Denver CO 80203, US ("we," "us," "our," or "Mainstay Naturals"). The Program is offered under our general Terms of Service at /legal; capitalized terms not defined here have the meanings given in the Terms of Service.

1. Program description

Through the Program, we send recurring automated marketing and promotional text messages to phone numbers enrolled in the Program. Messages may include sale promotions, product launches, restock alerts, cart and browse reminders, event notifications, exclusive offers for subscribers, and other messages related to your relationship with Mainstay Naturals.

Separately and not as part of this Program, we may also send transactional messages to a phone number you have provided to us (such as order confirmations, shipping updates, and customer-service replies). Transactional messages are not subject to your Program enrollment status and continue even if you opt out of marketing messages, until you ask us to stop transactional messages as well.

2. How you join

You may enroll in the Program by submitting your mobile phone number on an enrollment form on mainstaynaturals.com (or at checkout, point-of-sale, or another designated entry point) and affirmatively checking the Program opt-in box. Enrollment requires you to be at least 18 years old.

By checking the Program opt-in box, you authorize Mainstay Naturals (and its service providers) to send you recurring automated marketing text messages — including those sent via an "automatic telephone dialing system" or pre-recorded or artificial voice — to the mobile phone number you provided. Your consent to receive these messages is not a condition of any purchase. You understand that you can opt out at any time as described in Section 5.

After you submit your phone number and check the opt-in box, you will receive a confirmation text message asking you to reply Y (or YES) to complete enrollment. You are not enrolled until you respond. The confirmation message will identify Mainstay Naturals, will include opt-out and help instructions, and will state that message and data rates may apply.

3. Message frequency, carrier rates, and content

  • Frequency: Message frequency varies; typically up to 8 marketing messages per month, with occasional bursts around launches and promotions.
  • Carrier rates: Message and data rates may apply, based on the plan you have with your wireless carrier. Mainstay Naturals does not charge for the messages themselves, but your wireless carrier may.
  • Carrier liability: Wireless carriers are not liable for delayed or undelivered messages.
  • Time of day: We will not send marketing text messages outside the hours of 8:00 a.m. – 8:00 p.m. in the recipient's local time zone, except for transactional messages tied to your active order or account.
  • Volume limit: We will not send more than three (3) marketing text messages per twenty-four-hour period to any single mobile phone number.

4. Compatible carriers and devices

The Program is available on most U.S. carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for any carrier-related issue. Your mobile device must support SMS and have a service plan with your carrier. Not all carriers support all messaging features.

5. Opt-out — how to stop messages

You can opt out at any time by any of the following methods, each of which we treat as a valid opt-out request and a complete revocation of your prior express written consent to receive automated text messages from us:

  • Text STOP (or any other reasonable variant, including CANCEL, UNSUBSCRIBE, END, QUIT, REVOKE, or REMOVE) to the short code or phone number from which the messages were sent.
  • Email care@mainstaynaturals.com with the mobile number you would like removed.
  • Web form at /privacy-choices.
  • Written notice to Crane Health Holdings LLC, 1500 N Grant St #7971, Denver CO 80203, US, Attn: SMS Opt-Out (please include the mobile phone number you would like removed).

What an opt-out suppresses. Consistent with 47 C.F.R. § 64.1200(a)(10) and (a)(12) and the FCC's TCPA Opt-Out Rule effective April 11, 2025, when you opt out we will stop sending you all automated text messages and pre-recorded voice calls that require your consent under the TCPA, including marketing texts, promotional messages, cart and browse reminders, and other automated outreach. This applies across all message categories sent to the phone number you have opted out, regardless of which category the message you replied to belonged to.

One-time clarification message (optional). If, at the time you opt out, you are enrolled in more than one of our consent-required text categories, we may send you one (1) non-marketing confirmation text within five (5) minutes that (a) confirms your opt-out, (b) lists the specific categories of consent-required texts we send (such as marketing, browse reminders, and back-in-stock alerts), and (c) asks whether you wish to keep receiving any specific category. If you do not affirmatively reply to keep a category, we will stop sending all consent-required automated texts. If you affirmatively reply to keep one category, we will only continue that category and will stop all others.

Transactional messages tied to an active order. Non-automated transactional messages directly tied to an active order or account (such as a one-time order confirmation, shipping notification, or response from a customer-service agent) do not require TCPA consent and are sent on a separate operational basis. To stop these messages as well, reply STOP ALL to any such message or contact care@mainstaynaturals.com; we will suppress non-automated transactional texts as soon as commercially reasonable, generally within five (5) business days.

Timing. We will honor any opt-out request — whether by STOP keyword, any reasonable variant, email, web form, written notice, or any other reasonable method — promptly and in any event no later than ten (10) business days after we receive it. STOP-keyword opt-outs are honored immediately within our SMS platform.

6. Help

For help with the Program, reply HELP to any message you receive from us, email care@mainstaynaturals.com, or visit mainstaynaturals.com/contact. The HELP response will identify Mainstay Naturals, provide our customer-service contact, and reiterate opt-out instructions.

7. Privacy

Our collection and use of the information you provide in connection with the Program — including your mobile phone number, the timestamp of your consent, the IP address and user agent at the time of consent, and the exact opt-in disclosure shown — is described in our Privacy Policy at /privacy. We retain consent records for at least four (4) years after the end of your enrollment, consistent with the TCPA's federal statute of limitations.

We do not sell, rent, swap, or share Program opt-in data with third parties for those third parties' direct-marketing purposes. We do use third-party service providers (such as our SMS platform vendor) to send messages on our behalf as data processors under contract.

8. State-specific terms

This Section 8 sets out state-specific operational requirements that apply to residents of the listed states. Where a state-specific term differs from a more general term elsewhere in these SMS Terms, the state-specific term controls for residents of that state.

Common identity disclosures in every message. Every text message we send under the Program identifies (a) the sender by brand short name (Mainstay Naturals), and (b) where required by state law or carrier 10DLC review, includes a link to customer-service contact information. STOP and HELP keywords appear in the first message of each conversation and at the start of each calendar month.

Florida residents — Florida Telephone Solicitation Act (FTSA, Fla. Stat. § 501.059).

  • Pre-suit notice and 15-day cure. Before initiating any litigation under the FTSA, you must first request that we stop sending you text messages by replying STOP (or by an equivalent method listed in Section 5). We have fifteen (15) days from receipt of your request to honor it. We may send you a single confirmation text within that fifteen-day window confirming your opt-out. If you continue to receive automated text messages from us more than fifteen days after your request, please contact us at care@mainstaynaturals.com so we can investigate and remediate.
  • Caller identification. Each automated text message sent to a Florida resident identifies Crane Health Holdings LLC as the sender and includes a customer-service contact path (reply HELP or visit mainstaynaturals.com/contact).
  • Time of day. No automated text messages are sent to a Florida resident before 8:00 a.m. or after 8:00 p.m. local time, consistent with Fla. Stat. § 501.059.
  • DNC suppression. We scrub against the federal National Do Not Call Registry on a no-less-than-monthly cadence and against any active suppression list we maintain.

Maryland residents — Stop the Spam Calls Act (Md. Code Ann., Com. Law § 14-3201 et seq.).

  • Prior express written consent. We send automated marketing text messages to Maryland residents only after obtaining prior express written consent through a separate, unbundled, unchecked-by-default opt-in surface.
  • Time of day. No automated text messages are sent to a Maryland resident before 8:00 a.m. or after 8:00 p.m. local time.
  • Volume. No more than three (3) automated marketing text messages are sent to any single Maryland phone number in a twenty-four-hour period.
  • Sender identity in every message. Each automated text message sent to a Maryland resident identifies Crane Health Holdings LLC as the sender and a customer-service contact path.
  • DNC and internal suppression. We scrub against the federal National Do Not Call Registry and against our internal suppression list before each campaign send.

Oklahoma residents — Oklahoma Telephone Solicitation Act (Okla. Stat. tit. 15, § 775B.1 et seq.).

  • Prior express written consent. We send automated marketing text messages to Oklahoma residents only after obtaining prior express written consent.
  • Time of day. 8:00 a.m. – 8:00 p.m. local time.
  • Volume. No more than three (3) automated marketing texts per Oklahoma phone number in a twenty-four-hour period.
  • Sender identity in every message. Each message identifies Crane Health Holdings LLC and a customer-service path.
  • DNC and internal suppression. Same federal DNC + internal-suppression scrub before each send.

Washington residents — RCW 80.36.400 + RCW 19.190 (commercial-text statute).

  • Consent and content. We obtain consent before sending automated commercial text messages to a Washington phone number and identify the sender in each message.
  • Caller identification. Each automated text message sent to a Washington resident identifies Crane Health Holdings LLC.
  • DNC and internal suppression. Same federal DNC + internal-suppression scrub before each send.
  • Washington residents may report violations of these provisions to the Washington State Attorney General.

California residents.

  • California Business and Professions Code § 17592. We comply with California Business and Professions Code § 17592 with respect to the Program. We obtain prior express written consent before sending any automated commercial text message to a California phone number; each message identifies Crane Health Holdings LLC as the sender and includes a customer-service contact path (reply HELP or visit mainstaynaturals.com/contact); and we honor opt-out requests through any reasonable method, including any of the methods described in Section 5.
  • Time of day. No automated text messages are sent to a California resident before 8:00 a.m. or after 9:00 p.m. local time, consistent with industry best practice.
  • Privacy. California residents have the additional privacy rights described in Sections 15 and 17 of our Privacy Policy, including the right to opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising. Enabling Global Privacy Control in your browser is one supported method of exercising this opt-out for online tracking.
  • Session recording and analytics. We do not deploy third-party session-replay tools (such as FullStory, Hotjar, or Microsoft Clarity) on the Services. Our SMS service provider may record message-engagement metadata (sent, delivered, opened, clicked, replied) on our behalf as a data processor under contract; that engagement metadata is not third-party wiretap interception of customer interactions and is used solely for the operational purposes described in our Privacy Policy.

9. Reservation of rights

We may, in our discretion, change, suspend, or terminate the Program at any time, with or without notice. We may also change the short code, long code, or other phone number from which messages are sent.

10. Disclaimer of warranties and limitation of liability

The Program is provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties (express or implied) related to the Program, including any warranty of message delivery, deliverability, frequency, or content accuracy. Wireless carriers are not liable for delayed or undelivered messages, and we are not responsible for your wireless carrier's terms, service quality, or rate plan.

Section 17 (Limitation of Liability) and Section 19 (Governing Law) of the Terms of Service apply to the Program. Section 20 (Dispute Resolution; Arbitration; Class-Action Waiver) of the Terms of Service applies to disputes arising under the Program except that any claim arising under the federal Telephone Consumer Protection Act (47 U.S.C. § 227) or any state telephone-solicitation, automated-text-message, or mini-TCPA statute is expressly excluded from arbitration and from the class-action waiver and may be brought in any court of competent jurisdiction.

11. Changes to these SMS Terms

We may update these SMS Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated by reasonable means. Continued participation in the Program after a material change constitutes acceptance of the revised SMS Terms.
